1. About These Terms

These Terms of Service ("Terms") apply to the use of this website and to sales of new, used, and reconditioned industrial equipment by Chicago Industrial Equipment, Inc. ("we," "us," or "our") to business customers ("you" or "customer"). By using this website or placing an order with us, you agree to these Terms, together with any quote, purchase order, sales agreement, or invoice for your order. If a signed sales agreement or quote states terms that differ from these Terms, the sales agreement or quote controls for that order.

2. Equipment Sales: New, Used, and Reconditioned

We sell new, used, and reconditioned industrial material-handling equipment, including forklifts, aerial lifts, scissor lifts, boom lifts, telehandlers, and related machinery. Used and reconditioned equipment is pre-owned, and its condition varies by individual machine.

3. Equipment Availability

Equipment availability changes. Information on this website about the types of equipment we supply is not an offer of any particular machine. A machine is not reserved for you until we confirm it in writing and any required deposit or advance payment has been received.

4. Descriptions and Specifications

Descriptions, specifications, hours, and other details for a machine are provided for that individual machine in a quote or other written communication. Please review them carefully before ordering. Equipment photographs and illustrations on this website are for general illustration only and may not show the specific machine you purchase.

5. Quotes and Pricing

Prices are quoted for individual machines and orders. Unless a quote states otherwise, a quote is not a guarantee of price or availability and may be changed or withdrawn before you place an order. Quoted prices do not include shipping, taxes, or other charges unless the quote says so.

6. Purchase Orders and Sales Agreements

Purchases are made under a purchase order, sales agreement, or other written order accepted by us. An order is not binding on us until we accept it in writing.

7. Payment, Invoices, Deposits, and Advance Payments

Payment is invoice-based. Payment amounts, due dates, and accepted payment methods are stated in the quote, sales agreement, or invoice for your order. Where applicable, we may require a deposit or advance payment before we reserve or ship equipment, as stated in the quote or sales agreement. Late or unpaid amounts may delay shipment or result in cancellation of the order.

8. Equipment Condition

New equipment is sold as new. Used and reconditioned equipment is sold in the condition described in the quote or sales agreement. Condition, specifications, availability, pricing, hours, and included warranties vary by individual machine.

9. Inspections

Where applicable, equipment may be inspected and reconditioned before sale. Whether any inspection or reconditioning applies, and the scope of it, depends on the individual machine and is described for that machine. You may ask us about options for reviewing equipment before purchase.

10. Customer Responsibilities

You are responsible for providing accurate information about your requirements and delivery location, for confirming that the equipment you select meets your needs, and for the safe and lawful operation, training, maintenance, and use of the equipment after delivery, including compliance with applicable laws, regulations, and safety requirements. You are responsible for providing safe access and appropriate unloading arrangements at your delivery site.

11. Order Changes and Cancellations

Requests to change or cancel an order must be made to us in writing as soon as possible. Changes and cancellations are subject to our acceptance. Where equipment has been reserved, prepared, or shipped, or where a deposit or advance payment has been received, terms for changes, cancellations, and any deposit treatment are as stated in the quote or sales agreement.

12. Nationwide Shipping

We provide nationwide equipment shipping for commercial and industrial customers. Shipping arrangements, pricing, timelines, equipment size, destination, loading requirements, and transportation needs may vary by order and are confirmed for your order. Shipping and delivery dates are estimates only and are not guaranteed. Terms for responsibility for equipment during transit and transfer of title are as stated in the sales agreement or invoice.

13. Receiving and Inspection

Please inspect equipment on delivery. Note any visible damage or shortage on the delivery paperwork at the time of delivery and notify us promptly, in writing, of any concern. Delay in reporting a concern may limit our ability to address it with the carrier or otherwise.

14. Returns

Returns are available only where applicable and agreed to by us in writing, for example in the quote or sales agreement for the order. Equipment is not returnable unless we have agreed to accept the return. Any approved return is subject to the conditions, costs, and timing stated in that written agreement.

15. Warranties

We provide warranties only where they are expressly provided in writing for a specific machine. Nothing on this website is a warranty. Where no written warranty is provided, and to the fullest extent permitted by law, equipment is sold without warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Any manufacturer's warranty that may apply is provided by the manufacturer and not by us.

16. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, downtime, or loss of use, arising out of or relating to the website, equipment, or an order. To the fullest extent permitted by law, our total liability for any claim relating to an order will not exceed the amount you paid to us for the specific equipment that is the subject of the claim. Nothing in these Terms limits liability that cannot be limited by law.

17. Website Use and Inquiries

You agree to use this website only for lawful business purposes and to provide accurate information in any inquiry or quote request. Submitting an inquiry does not create an order or obligate either party to a transaction. Our handling of information you submit is described in our Privacy Policy.

18. Governing Law

These Terms and any order or dispute arising out of them are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any legal action relating to these Terms or an order will be brought in the state or federal courts located in the State of Illinois, and you consent to those courts' jurisdiction.

19. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last revised. The Terms in effect when an order is accepted apply to that order.
